Civil Litigation Process

The civil litigation process goes through four steps that include pleadings, discovery, trial and appeal. However, at anytime either party can stop the process by voluntarily settling.  Listed below is a further explanation of each step.

Pleadings: This is the initial step in a civil suit. Both parties will file paperwork to explain their side of the story. The party bringing the suit, the plaintiff, will file a complaint while the party being alleged of a wrongdoing, the defendant, will file an answer. An answer is a response to the plaintiff’s complaint.

Discovery: This step is usually the longest and most labor-intensive portion of the case. In this process, both parties will gather information that will strengthen their arguments. Information can be gathered through written questions, request for documents, request for admission and depositions.

Trial: If the dispute has not been settled or resolved out of court by this point, the case will move to trial. This process can take anywhere from several months to a few years to complete.

Not every suit will go through each stage, in fact, the majority of them do not. Most of the cases never reach the courtroom and are instead settled with an agreement between the parties. Parties can also settle during a trail or after the jury has begun deliberation or delivered a verdict. Some parties may settle on some aspects of the suit, and leave the others for the judge or the jury to decide.
