Product Liability
We encounter countless numbers of products a day, and unfortunately these products cause thousands of injuries a year. When an individual sustains an injury from a defective product, there are a number of parties that can be held liable. Liability can range from the manufacturer to the individual who assembled or installed the product.
Defective products include a wide variety of things such as medical devices, vehicles, food, and cosmetics. If a defective product has injured you, you should contact legal counsel immediately to learn your rights. Companies must be held to account for selling products that are defective, otherwise dangerous products will flood the market at increasing rates.

Types of Product Defects
If you are injured by a defective product you may be able to file a lawsuit against the wholesaler, distributor, or the manufacturer. If you plan to do so there are three claims you can make. Those claims include design defect, manufacturing defect and warning/labeling defect. A further explanation of each clam is listed below.
Design Defect: This is considered a flaw in the original design that resulted in the product being dangerous and potentially hazardous to the consumer. There are three questions that are asked to determine if a design defect exists. They include the following:
- Was the design dangerous before production?
- Was there reason to believe the product could harm the consumer?
- Could the manufacturer have used another design that would not change the purpose of the product?
Manufacturing Defects: This is the most common cause of product liability claim and is caused by an error in the assembly that is not supposed to be part of the product. This defect only affects a small number of a company’s manufactured goods.
Warning/ Labeling Defects: This mainly deals with prescription medications. A patient may take a certain medication and experience adverse side effects that were not listed by the pharmaceutical company. This can also occur with nearly any type of product, not just medications. It should be noted that manufactures are not required to list every possible risk.
